These Terms of Service ("Terms") govern the lawn care and landscaping services provided by Two Oaks Landscaping ("Two Oaks Landscaping," "we," "us," or "our") to you ("you" or "Customer"). By requesting, scheduling, or accepting our services, you agree to these Terms.

1. Services

We provide lawn care and landscaping services as described in your service agreement, estimate, or as otherwise arranged between us. The specific scope, frequency, and price of services will be agreed upon between you and Two Oaks Landscaping. We may use reasonable judgment in performing the work and may adjust scheduling as needed.

2. Scheduling and Weather

Service dates are estimates and may be affected by weather, equipment, staffing, or other conditions outside our control. We will make reasonable efforts to reschedule affected services promptly. We are not responsible for delays caused by conditions beyond our reasonable control.

3. Property Access and Customer Responsibilities

You agree to provide safe and unobstructed access to the areas where services are to be performed. You are responsible for identifying and marking any hidden hazards or items that could be damaged or cause damage, including but not limited to irrigation heads, low-voltage wiring, invisible pet fencing, septic components, and similar features. You agree to keep the service area clear of pets, debris, toys, and personal property during scheduled service. We are not responsible for damage to unmarked or concealed items.

4. Payment Terms

Payment is due as stated on your invoice or service agreement. Invoices not paid by the due date may be subject to a late fee and suspension of service. You are responsible for any costs of collection, including reasonable attorney's fees, on past-due balances.

5. Cancellation

Either party may cancel recurring services with reasonable advance notice as described in your service agreement. Fees for services already performed remain due.

6. Text Messaging Program

If you provide your mobile number and opt in, Two Oaks Landscaping may send you text messages related to your account, including service and scheduling confirmations, arrival ("on the way") notifications, and billing and payment reminders. Message frequency may vary. Message and data rates may apply. You can opt out at any time by replying STOP, and you can get help by replying HELP or contacting us. Carriers are not liable for delayed or undelivered messages. Your participation is also subject to our Privacy Policy.

7. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Lawn and plant health depend on many factors outside our control, and we do not guarantee any specific result, growth, or appearance.

8. Limitation of Liability

To the fullest extent permitted by law, the total aggregate liability of Two Oaks Landscaping to you for any and all claims arising out of or relating to our services or these Terms — whether based in contract, warranty, negligence, or any other legal theory — shall not exceed the total amount you paid to Two Oaks Landscaping for services during the six (6) months immediately preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless Two Oaks Landscaping from any claims, damages, or expenses arising out of your breach of these Terms or your failure to identify hazards or items as described in Section 3.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in [COUNTY] County, North Carolina, and you consent to the jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
